This month in San Francisco a federal district
court judge ruled that a lawsuit filed against
Target Corp. by the National Federation of the Blind
can move forward. The judge ruled that a retailer
can be sued if its website is inaccessible to the
blind.
Target asked the court to dismiss the case as no
law requires Target to make its website accessible.
Specifically, Target stated that federal civil
rights laws don’t apply to websites because websites
aren’t physical places of public accommodation and
asserted that applying California statutes to its
website would violate the Commerce Clause of the
U.S. Constitution because the website is accessible
to consumers nationwide.

Earlier this month comScore Media Metrix released
an analysis of consumer visits to the top online
classified sites. In the past year, traffic to
online classified sites grew 47 percent from 25,487
to 37.4 million Internet users (approximately 22
percent of the total Internet population).
San Francisco – based Craigslist.org was the
leading classified website attracting 13.8 million
visitors in July 2006, up 99 percent from the past
year. Trader Publishing Company ranked second with
10.2 million visitors (up 15 percent), while
AutoTrader ranked third with 6.4 million visitors
(up 14 percent).
